Proposed Constitution Referred to Attorney General for Legal Analysis and Opinion

On Monday, Governor de Jongh submitted an official request to Attorney General Vincent Frazer for a legal analysis and opinion with respect to the Proposed Constitution recently submitted by the Fifth Virgin Islands Constitutional Convention. The Governor’s request letter to the Attorney General was issued on the same date that the Proposed Constitution was received at the Governor’s Office.

de Jongh said it is his understanding that the Proposed Constitution must meet certain constitutional and legal requirements as set forth in Act 6688 (Local Law) and Public Law 94-584 (Federal Law). de Jongh requested that the Attorney General provide him a statement of the legal requirements of both federal and local laws and a legal opinion as to whether the Proposed Constitution meets those requirements. 

de Jongh also said that the Attorney General’s opinion would detail what action, if any, is required of the Governor with respect to the Proposed Constitution.
